Before the pandemic, level 2 diagnostic studies required a radiologist to be physically present at the facility at the time of the procedure to meet the CMS’ “immediate availability” rule for contrast studies. Amid public health concerns during the pandemic, the CMS temporarily allowed supervisory personnel to meet the “immediate availability” requirement through two-way audiovisual telecommunications technology, a rule that has now been made permanent as of January 2026. Industry experts like Reed Smith LLP believe that these changes have the potential to greatly improve access to diagnostic services, especially in areas that consistently struggle with provider shortages, as the model eliminates travel requirements and enables radiologists to supervise procedures taking place in multiple locations.
However, as level 2 diagnostic studies involve the use of intravenous iodine- or gadolinium-based solutions, which may cause adverse and possibly life-threatening reactions, imaging networks that do adopt virtual supervision as an alternative model must remain aware of changing federal, state, and local regulations, or they may jeopardize patient safety and face risks of legal exposure.
"To remain compliant, imaging networks must thoroughly document procedures, have clear emergency protocols in place, train medical staff on an ongoing basis, and maintain clear communication channels with patients, doctors, paramedics, and supervisory personnel," explains Dor Shoshan, CEO of ContrastConnect. The technology used must also comply with HITECH and HIPAA standards to ensure patient safety and privacy are maintained; audio-only programs or consumer telecommunications platforms like Zoom or FaceTime are strictly prohibited.
